Why Do You Need Rent Receipts?
Your employer needs proof that you are actually paying rent to grant you the tax exemption. A rent receipt serves as a legally recognized acknowledgment from your landlord that they have received the rent amount for a specific period.
Without valid rent receipts submitted before the end of the financial year, your employer will deduct tax (TDS) on your entire HRA amount.
Mandatory Elements of a Valid Rent Receipt
For a rent receipt to be accepted by your employer and the Income Tax Department, it must contain:
Revenue Stamp Requirement
If you are paying rent in cash and the amount exceeds ₹5,000 per receipt, a ₹1 Revenue Stamp must be affixed to the receipt, and the landlord must sign across the stamp. If payment is made via bank transfer, cheque, or UPI, a revenue stamp is generally not required, but it is always good practice to have the landlord's signature.
The Landlord PAN Rule
This is where many employees face issues: If your total rent payment during the financial year exceeds ₹1,00,000 (i.e., more than ₹8,333 per month), it is mandatory to provide your landlord's PAN to your employer.
If your landlord does not have a PAN, they must provide a signed declaration to that effect. However, if they have a PAN but refuse to share it, you will not be able to claim the HRA exemption for rent paid above ₹1,00,000.
